The VelocityNex Service

VelocityNex (a DBA of Remarqably Digital Ventures, LLC) provides data pipeline, analytics, and forecasting tools.

• •Informational Nature: Our Service is a tool to assist in operational visibility. It is not a replacement for professional management or independent judgment.
• •Agreement Hierarchy: If you have signed a separate Master Service Agreement (MSA) or Statement of Work (SOW) with VelocityNex, the terms of that signed agreement will prevail in the event of a conflict with these website Terms.

Permitted Use & Restrictions

You may use the Service only for lawful business purposes. You agree not to:

• •Reverse Engineer: Attempt to extract the source code or underlying algorithms of our ETL pipeline or forecasting models.
• •Scrape Data: Use automated systems to extract data from our dashboards for use in third-party applications without written consent.
• •Unauthorized Access: Attempt to bypass our multi-tenant isolation or access data belonging to another tenant.
• •Input Malicious Data: Provide data to our Service that contains viruses, malware, or is intended to disrupt our AWS infrastructure.

Forecasting & AI Disclaimer (IMPORTANT)

Our Service provides predictive analytics and volume forecasting.

• •Not a Guarantee: Forecasts are based on historical patterns and probabilistic models. They are 'best estimates' and not guarantees of future performance or wait times.
• •External Factors: You acknowledge that queue volumes are affected by unpredictable external factors (weather, local events, policy changes) that our models may not account for.
• •No Reliance: VelocityNex is not responsible for staffing shortages, operational delays, or service level failures resulting from your reliance on our forecasts. All operational decisions remain your sole responsibility.

Intellectual Property

Our Property: VelocityNex owns all rights, titles, and interests in the Service, including our custom dashboard designs, ETL logic, and proprietary 'Product Tiers' hierarchy.

• •Your Data: You retain ownership of the raw data you provide. By using the Service, you grant us a limited license to process and transform this data to provide you with analytics.

Limitation of Liability & Indemnification

Cap on Liability: To the maximum extent permitted by California law, VelocityNex's total liability for any claim arising out of the use of this website or Service shall not exceed the amount you paid us in the past twelve (12) months, or one hundred dollars ($100), whichever is greater.

• •Consequential Damages: We are not liable for lost profits, lost data, or business interruption.
• •Indemnity: You agree to indemnify and hold VelocityNex harmless from any claims arising from your breach of these Terms or your use of our analytics in a manner that violates third-party rights.

Service Availability & 'As-Is' Status

While we strive for 99.9% uptime for our dashboards, the Service is provided on an 'as is' and 'as available' basis. We do not warrant that the Service will be uninterrupted or error-free. We reserve the right to perform maintenance or update the Service architecture (e.g., our AWS Lambda or RDS configurations) at any time.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action shall be brought exclusively in the courts located in Los Angeles County, California.
